Option for additional 1 MW Emergency Mobile Boiler Houses (Lot 1.11-1.15)

If the bidder is able to offer more than ten (10) 1 MW e-MBH, GIZ reserves the right to assign up to five (5) of the additionally offered lots as option to the secured funds, provided that the corresponding capacities are available.

It should be noted that the unit price for the option must be identical to that of all other lots within the lot package and that all other provisions of the contract and the annexes shall continue to apply unchanged to the option. Any option offered is not subject to evaluation. However, if it has been offered, the client has the right to extend the scope of the original order (up to ten (10) 1 MW e-MBH) by increasing the quantity by the offered option of up to five (5) additional 1 MW e-MBH (but not more than 50% of the comissioned scope) by written notification to the contractor.

This option shall be exercised within the award/binding period, provided that the budget is available.

If the bidder is able to offer more than five (5) 2 MW e-MBH, GIZ reserves the right to assign up to two (2) of the additionally offered lots as option to the secured funds, provided that the corresponding capacities are available.

Offenes Verfahren

Die Angebotsfrist soll gemäß § 15 Abs. 3 VgV auf 15 Kalendertage, gerechnet ab dem Tag nach Absendung der Auftragsbekanntmachung, verkürzt werden. Die hierfür erforderliche, nach objektiven Gesichtspunkten zu beurteilende und hinreichend begründete Dringlichkeit liegt vor. Sie beruht insbesondere auf der jüngsten konkreten Eskalation der Angriffe auf die ukrainische Energieinfrastruktur und den daraus entstehenden kurzfristigen und standortbezogenen Versorgungsbedarfen.
Zeitpunkt, Zielrichtung und Umfang der konkreten Angriffe Ende August und Anfang September 2026 sowie deren kumulative Auswirkungen auf die Versorgungslage unmittelbar vor der Heizperiode waren nicht vorhersehbar.

Einlegung von Rechtsbehelfen

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as

1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,

2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice

3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,

4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.

Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.

Bidders net turnover in the field of heat generation systems - Companies that have not generated an average net annual turnover of more than EUR100.000 (per lot offered) in the field of heat generation systems in the years 2023, 2024 and 2025, are deemed unsuitable and excluded from the procedure.
In case of doubt, GIZ reserves the right to demand corresponding substantiation, e.g. certified financial statements.

Technical and professional capacity - Reference Projects - In the last three years prior to this bid, the bidder has gained experience in supply and commissioning support of heat generation systems and can substantiate this with at least three reference projects.
At least one out of these three reference projects needs to be in Ukraine.
Bidding/service delivery consortia that cannot provide substantiation the adjacent preconditions, are deemed unsuitable and excluded from the procedure.

Maßnahmen zur Sicherstellung der Qualität

Technical and professional capacity - Certification - The bidder or, where the bidder is not the manufacturer of the offered equipment, the respective manufacturer on which behalf the bidder acts shall demonstrate the availability of ISO 9001 (or equivalent) certificates, covering the relevant manufacturing activities. A valid certificate from an accredited certification body or equivalent evidence will be accepted as proof.

Self declaration on EU-Russia Sanctions - The bidder confirms that he does not qualify as (a) person(s), entity(ies) or body(ies) with a connection to Russia referred to in Article 5 k) (1) of Council Regulation (EU) No. 833/2014 in the most recent version concerning restrictive measures in view of Russia"s actions destabilising the situation in Ukraine, a) by the Russian nationality of the candidate/bidder or the establishment of the candidate/bidder in Russia,
b) by a natural person, entity or body to which one of the criteria referred to in letter (a) applies holding a stake in the candidate/bidder by owning proprietary rights of more than 50%, c) by the candidate/bidder acting on behalf or at the direction of persons, entities or bodies to which the criteria referred to in letters (a) and/or (b) apply. Companies involved in the contract as subcontractors, suppliers or companies whose capacities are used in connection with the provision of proof of eligibility which account for more than 10% of the contract value also do not belong to the group of persons with a connection to Russia within the meaning of the provision. Finanzierung

An advance payment of 100% of the order value shall be made upon presentation of an advance payment guarantee in accordance with the GIZ"s template. The original advance payment guarantee must be submitted within 10 calendar days of the order being placed. Otherwise, the Client reserves the right to cancel the order.
