Die Angebotsfrist soll gemäß § 15 Abs. 3 VgV auf 15 Kalendertage, gerechnet ab dem Tag nach Absendung der Auftragsbekanntmachung, verkürzt werden. Die hierfür erforderliche, nach objektiven Gesichtspunkten zu beurteilende und hinreichend begründete Dringlichkeit liegt vor. Sie beruht insbesondere auf der jüngsten konkreten Eskalation der Angriffe auf die ukrainische Energieinfrastruktur und den daraus entstehenden kurzfristigen und standortbezogenen Versorgungsbedarfen.
Zeitpunkt, Zielrichtung und Umfang der konkreten Angriffe Ende August und Anfang September 2026 sowie deren kumulative Auswirkungen auf die Versorgungslage unmittelbar vor der Heizperiode waren nicht vorhersehbar.

Review procedure

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as

1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,

2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice

3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,

4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.

Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.

Net annual turnover - Proof of annual net turnover of more than 300.000 EUR in the years 2023, 2024, 2025 in the supply of Leak detection devices. Bidding/service delivery consortia that cannot provide them are deemed unsuitable and excluded from the procedure.

Self-declaration on EU Russia sanctions - The bidder has to submit the following binding declaration (if applicable, also on behalf of the persons represented in the request to participate/offer):

1. The candidate(s) / bidder(s) does/do not
qualify as (a) person(s), entity(ies) or body(ies) with a connection to Russia referred to in Article 5 k) (1) of Council Regulation (EU) No. 833/2014 in the most recent version concerning restrictive measures in view of Russia"s actions destabilising the situation in Ukraine ,

Financial information

An advance payment of 100% of the order value shall be made upon presentation of an advance payment guarantee in accordance with the GIZ"s template. The original advance payment guarantee must be submitted within 10 calendar days of the order being placed. Otherwise, the Client reserves the right to cancel the order.
