Delivery, installation of an Data Diode (Hardware and Protocols) for a partner in Albania. The delivery shall be made in accordance the DPU (delivery at place unload, INCOTERMS 2020) to GIZ Albania. In addition On-Site installation, configuration and training for the partner organisation is required.

Review procedure

According to Article 160, Section 3 of the German Act Against Restraint of Competition (GWB), application for review is not permissible insofar as

1. the applicant has identified the claimed infringement of the procurement rules before submitting the application for review and has not submitted a complaint to the contracting authority within a period of 10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected,

2. complaints of infringements of procurement rules that are evident in the tender notice are not submitted to the contracting authority at the latest by the expiry of the deadline for the application or by the deadline for the submission of bids, specified in the tender notice

3. complaints of infringements of procurement rules that first become evident in the tender documents are not submitted to the contracting authority at the latest by the expiry of the deadline for application or by the deadline for the submission of bids,

4. more than 15 calendar days have expired since receipt of notification from the contracting authority that it is unwilling to redress the complaint.

Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.

Specific yearly turnover

Company's net annual turnover in the field of supply and delivery - Companies that have not generated net annual turnover of more than EUR400.000 in the field of supply and delivery of security hardware equipment in the years 2022, 2023 and 2024 are deemed unsuitable and excluded from the procedure. In case of doubt, GIZ reserves the right to demand corresponding substantiation, e.g. certified financial statements.

Reference project - In the last three years prior to this bid, the company has gained experience of supply and delivery of security hardware equipment and can substantiate this with at least one reference project.
Bidding/service delivery consortia that cannot provide substantiation for at least one reference projects that satisfy the adjacent preconditions, are deemed unsuitable and excluded from the procedure.

Self-declaration EU-Russia-Sanctions - The bidder confirms that they are not one of the individuals or companies connected to Russia, as defined in Article 5k(1) of EU Regulation 833/2014, which includes:

a) being a Russian citizen or based in Russia,
b) being owned (more than 50%) by someone who meets the above point,
c) acting on behalf of or under the instructions of such a person or company.

This also applies to any subcontractors, suppliers, or other companies helping to meet the qualification requirements, if they are responsible for more than 10% of the contract's value. The bidder also guarantees that no such companies will be involved during the contract if their share exceeds 10%.
